| Proposed Yellow Perch Regulations for 2009 |
|
The 2009 proposed regulations for yellow perch maintains the size limits for the fishery. The action creates a season (Jan. 1 – March 10, inclusive), fishing areas (Upper Bay (not including the Magothy River) and the Patuxent River), daily catch limits for hook and line (10 fish per person per day) and the Patuxent River fishing area (100 lbs per person per day), a harvest permit, the method of registration for a permit, a tagging system that includes an exemption and process for the live yellow perch market, a reporting system to account for all of the yellow perch harvested, a public notice provision, and a penalty provision for failure to report. In order to alleviate user conflict, the action extends the fyke net prohibition (February 1 - March 31, inclusive) and establishes new lines with latitude and longitude coordinates to exclude fyke nets from upstream tidal areas in locations open to the commercial harvest of yellow perch and of importance to recreational yellow perch fishermen.

Commercial Crabbing Holiday Provision |

Code of Maryland Regulation provides that a commercial crab licensee may catch crabs on their declared day off of either Sunday or Monday if the Sunday or Monday precedes a State or Federal holiday that falls on a Tuesday, Wednesday, Thursday, or Friday of the particular week. Therefore, crabbing will be permitted on May 25 and 26, June 29 and 30, August 31 and September 1, October 12 and 13, November 2 and 3, 9 and 10 and 23 and 24, 2008. |

2008 COMMERCIAL WEAKFISH SEASONS SET |

The Secretary of Maryland Department of Natural Resources pursuant to Code of Maryland Regulation 08.02.05.13(E) has announced that the Atlantic weakfish fishery for gill nets and other gears, except trawl nets, will open at 12:01 am, Wednesday, March 26, 2008 and continue to 12:00 pm midnight, Friday, April 25, 2008. This fishery for gill nets and other gears will reopen at 12:01 am Wednesday, September 3, 2008 and continue to 12:00 pm midnight, Friday, November 14, 2008. A licensee using gill nets and other gears in the Atlantic may not catch or land weakfish on Sundays during these open seasons.
The Atlantic weakfish trawl net fishery will open 12:01 am, Friday, October 17, 2008 and continue to 12:00 pm, midnight, Monday, December 29, 2008. A licensee using a trawl net may not catch or land weakfish on Saturdays or Sundays.
The Chesapeake Bay commercial weakfish fishery for all gears will open at 12:01 am, Tuesday, August 5, 2008 and continue to 12:00 pm, midnight, Tuesday, September 30, 2008. A licensee may catch and land weakfish from the waters of the Chesapeake Bay on any day during the open season.
During the closed weakfish season, a commercial licensee targeting species other than weakfish with gear other than hook and line may possess or land in any one day no more than 150 pounds of legal-sized weakfish as by-catch, provided that there is at least an equal poundage of species other than weakfish on board the vessel. During the closed weakfish season, a commercial licensee using hook and line may not land weakfish as by-catch.
All other current rules and regulations remain in effect for each weakfish season. The allowable harvest days for the commercial weakfish fishery are consistent with the Weakfish Fisheries Management Plan approved by the Atlantic States Marine Fisheries Commission.

COMMERCIAL SPINY DOGFISH FISHERY LANDING LIMITS IN MARYLAND
WATERS |

The Secretary of Maryland Department of Natural Resources announces clarifications for the spiny dogfish fishery that opened in Maryland waters Saturday, November 1, 2008. A Maryland commercial licensee without a federal spiny dogfish permit from the National Marine Fisheries Service (NMFS) may possess or land in Maryland up to 3000 pounds of spiny dogfish per day per vessel caught from Maryland waters (0 – 3 miles from shore). A Maryland commercial licensee with a federal spiny dogfish permit may temporarily relinquish the permit to NMFS in order to possess or land spiny dogfish caught from Maryland waters. Federal waters (EEZ, 3-200 miles from shore) are closed to spiny dogfish harvest. Daily landings from Maryland waters may be modified or the fishery closed if NMFS determines the spiny dogfish fishery quota is reached.
